Terms and Conditions

“Cuddly Bear Wear” terms and conditions comply with UK legislation. They are structured to ensure that customers can shop easily and with confidence. By using our website you accept these terms and conditions. These terms and conditions may change without prior notice and will not affect your statutory rights.

1. GARMENT/CLOTHING – (The items you provide for adjustment). If a garment is too worn or too old to re-construct, we have the right to refuse adjustment and your garment/s and payment will be returned.

2. PRIVACY POLICY – We do not sell, trade, or rent any of your personal information to others. “Cuddly Bear Wear” will only use the information provided by you in accordance with the Data Protection Act 1998.

3. PRICES – All prices are quoted in pounds sterling and are inclusive of VAT unless otherwise stated. Any applicable postage & packing and VAT is payable by you in addition to the contract price.

• All item prices do not include postage and packaging
• Prices are correct at the time of order

4. PAYMENT – Payment must be made in pound sterling by cheque or Postal Order, made payable to “Cuddly Bear Wear” and sent to the following address: KINGSTON HOUSE, SUITE 50. DENBY GRANGE. HARLOW. ESSEX. CM17 9PZ.

Bank transfer or payment via PAYPAL will also be accepted. For account customers our terms are strictly 30 days net.

Please note: If payments are being made by cheque or Postal Order, delivery may be a least 7 days later than times stated. This is due to the clearance of cheques/Postal Orders via the banking system. Cuddly Bear Wear will not commence work on your garments, until cheques/Postal Orders have cleared our banking account.

5. POSTAGE – We recommend that when posting clothing to “Cuddly Bear Wear” you record your package so that you have a record of your delivery to us. We cannot be made responsible for any packages being posted to us. Postage and packaging are not included in the item price. Prices are stated as detailed on the “Cuddly Bear Wear” website and are correct at the time of ordering.

Postage cost will be £1.99 for 1 item, £3.99 for 5 or less items and £4.99 for 6 to 10 items. For orders over 10 items please contact us for postage prices.

International shipping to overseas will attract an additional charge of £7.99

6. RETURNED POSTAGE – we will deliver returned items to you by recorded delivery. You will be required to sign to acknowledge receipt of your order when it is delivered.

7. DELIVERY – Goods are delivered by Royal Mail or Courier and will require a signature on receipt. If delivery has to be attempted more than twice due to the recipient not being available to receive the goods, a second delivery charge may be made. Furthermore, if the recipient requires a delivery to be redirected, a second delivery charge may also be incurred.

8. NON DELIVERY - Damage in Transit. Please note that we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivering goods. In the unlikely event that your product appears lost or is damaged in transit then please use our enquiry form immediately to notify us. You must keep the original packaging in case you have any reason to return your purchase.

9. ACCEPTANCE - By sending your garment to us at “Cuddly Bear Wear” you will have consented and given agreement for us to cut and re-sew the garments to the adjustment sizes stated on your order.

All sizes are approx, and are made to the nearest centimetre. Please note that any excess material WILL NOT be returned to you and will be discarded when the garment is resized and completed.

10. FAULTY ADJUSTMENTS – If for any reason you are not satisfied with the adjustments that have been made to the garment, then please return the garment with a copy of your order details, the receipt, and a cover note of the reason for return. You have up to 7 days to return the garment(s) to us.

• If the garment is returned because it does not fit your cuddly toy, but the adjustments are made correct to your measurements details as specified on your order then you will not be entitled to a refund.
• In the unlikely event that you experience the garment having faulty stitching, or if workmanship seems to be unacceptable, (by unacceptable it is meant by faulty stitching, uneven garment i.e. one sleeve shorter than the other, wrong garment sent to you, garment looks completely different from original style sent, i.e. dress turned into a skirt.) then in these or similar situations you may be entitled to a refund. Payment for the postage made on returned goods will be reimbursed to you.

11. ACCURACY OF CONTENT – “Cuddly Bear Wear” make every effort to ensure that specifications and product details are correct and have taken every care to ensure that the colours and photographs shown on the website give a true representation of the garments.
We reserve the right to make changes to the items shown on our website. The prices quoted on our website are valid for Internet sales only and we reserve the right to change prices without notice.

When an order is placed the customer will be notified by email to confirm receipt of the order.

12. SATISFACTION GUARRANTEE - We at “Cuddly Bear Wear” aim to re-construct selective items of recycled clothing to the size of your cuddly toy. If however garment sizes when returned to you are incorrect, we will gladly accept any returns to correct the garment to your specific size instructions. If we are at fault we will gladly give a full refund and will freely send garments made to the correct size of order if possible. If we are unable to correct, then a full refund will apply.

Please note that a copy of your original order measurements and proof of purchase will be required. If you have any questions about this then please contact us by telephone or e-mail.

“Cuddly Bear Wear” endeavours to be accurate with all product details and prices, if a product or price is incorrect due to a typographical error we have the right to refuse or cancel any order whether or not the order has been confirmed. We have made every effort to display the colours of our clothing ranges as accurately as possible. However, as the actual colours that you see will depend on your monitor, we cannot guarantee that your screen will accurately render the exact shade of the product that is delivered to you.

13. CANCELLATION OF ORDER - Cancellation of any order may be made before any resizing of a garment.

14. FORCE MAJEURE – “Cuddly Bear Wear” will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any goods by any reason or cause beyond the control of “Cuddly Bear Wear”.

15. RISK and OWNERSHIP - The risk in the goods passes to you when the goods are delivered to the delivery address. Ownership of goods remains with “Cuddly Bear Wear” until payment for the goods are received in full.

16. COMPLAINTS - We aim to provide a high standard of customer service. If however we do get it wrong we will do everything in our power to put it right! We will acknowledge any complaint emailed to us.

17. PRODUCT INFORMATION - “Cuddly Bear Wear” clothing and accessories are recommended for children 5 and over. All recycled clothing will be adjusted to fit your cuddly toy of which when sent back to you will be your responsibility to the aspect of safety to your child/children.
